Conditions of Sale

These General Conditions of Sale govern the offer and sale of Products (hereinafter "Product", jointly "Products") on the Site https://pskmegastore.com (hereinafter "Site" or "PSKMEGASTORE").

The Products purchased on the Site are sold by PSK AD NETWORK SRL (hereinafter "PSKMEGASTORE"), with registered office in Via Terminio 7, 80026 Casoria, Naples, Italy, VAT number: IT08560181219 - REA NA: 967358

The sales prices indicated are expressed in euros, VAT included, and do not include shipping costs. The latter, if they exist, are always borne by the Customer and are attributable at the time of order confirmation. PSKMEGASTORE reserves the right to update the prices indicated on the Site, without prejudice to the Customer's rights with respect to the prices indicated at the time of the order.

The offer and sale of the Products on the Site comply with the provisions of the Legislative Decree. n. 206/2005 (so-called Consumer Code), and subsequent amendments and additions, as well as those provided for by Legislative Decree no. 70/2003 (implementing Directive 2000/31/EC relating to certain legal aspects of information society services in the internal market, with particular reference to electronic commerce).

We invite you to carefully read what is indicated in detail below, since by making a purchase through the Site you fully accept these conditions of sale.

We also remind you that the purchase of Products through the Site can only take place after registering on it and is permitted both to users who have the status of consumers and to users who do not have this status.

The purchase is permitted for natural persons only on the condition that they are at least 18 years of age.

Delivery time

The delivery times indicated on the product page and on the other pages along the purchase process on the site are indicative estimates calculated on the basis of the statistical data held by PSKMEGASTORE and the type of delivery available for the purchase of a specific product.

These estimates are calculated on an annual basis and are based on the simple subtraction of two factors:

Merely by way of example, curbside delivery days in large metropolitan cities (Rome, Milan, Naples, etc.) are between 2 and 3 days, in the major and minor islands the average is 3/4 days, ditto for the areas considered by couriers to be "disadvantaged" by way of example: mountain locations or not served by long-distance roads.

Delivery methods

Deliveries of household appliances are made with vehicles equipped with a hydraulic tail lift. If access to the house is not possible with a means of this type, the feasibility of delivery must be requested before ordering (in particular cases, delivery may involve the payment of a supplement to be agreed upon).

Orders placed online are delivered throughout Italy, with the exception of Livigno, Campione d'Italia, Vatican City and the Republic of San Marino.

Large household appliances (washing machines, refrigerators, dishwashers, etc.) are delivered within Italy, excluding the Venice Lagoon Area.

1) Express Courier 

The Express Courier service is a delivery made from Monday to Friday from 08.30 to 18.00 at street level. 

We would like to point out that, as already mentioned above, the delivery times indicated by PSKMEGASTORE starting from the product sheet, on the other pages along the purchase process on the site and up to the order confirmation, are indicative estimates calculated on the basis of the data statistics in possession of PSKMEGASTORE and the type of delivery available for the purchase of a specific product. These estimates are calculated on an annual basis and are based on the simple subtraction of two factors:

It is understood that in certain situations as listed below, PSKMEGASTORE reserves the right to indicate to the Customer, instead of the estimated delivery time, the actual date of entrustment of the goods to the courier.

situations relating to or connected to the particular geographical area in which the delivery is to be made;

periods linked to main holidays and anniversaries;

extraordinary circumstances (e.g. union strikes, natural disasters, sociopolitical events, etc.);

rescheduling of deliveries requested by the customer and agreed with the technical couriers or express couriers who provide the possibility of changing the date and/or time of delivery;

communication by the customer of incorrect data that requires rectification;

other unpredictable events (e.g. theft, accidents of delivery vehicles, technical problems and/or breakdowns, etc.).

In the event that the purchased Product is not delivered within the times indicated, the Customer can take advantage of the provisions pursuant to art. 61 paragraph III of the Consumer Code.

In any case, delivery will take place no later than thirty days from the date of conclusion of the contract.

Shipping Cost

As described above, the cost of transport is calculated in relation to the volume and/or weight of the items ordered by the Customer. There are additional (extra) services such as insured shipping and delivery by appointment (our "Shopping Cart" automatically recalculates the order total every time you add or delete an extra option).

Payment methods

Payment for the Products purchased through the Site can be made using the payment methods described:

Credit Cards Visa Mastercard circuit.

In cases of purchase of goods with credit card payment method, at the conclusion of the online transaction, the relevant banking institution will authorize the commitment only of the amount relating to the purchase made.

The accepted credit cards are all those that rely on the Visa and Mastercard circuits.

In the event of cancellation of the order, either by the Customer or in the case of non-acceptance by PSKMEGASTORE, the same will simultaneously request the cancellation of the transaction and the release of the committed amount. Cancellation of the order is possible until it is still being prepared in the warehouse. The status of the order is clearly visible in the "Order status" area and can no longer be canceled if the indication "Order shipped" appears. The release times, for some types of cards, depend exclusively on the banking system and can extend up to their natural expiry (24th day from the authorization date). Once the cancellation of the transaction is requested, under no circumstances can PSKMEGASTORE be held responsible for any damages, direct or indirect, caused by delay in the failure to release the committed amount by the banking system.

Bank transfer

The bank transfer does not include any additional costs.

By choosing this method, the user will receive the details for making the payment in the order summary email. The shipment, in this case, will start as soon as the amount is credited to our current account; at that moment the user will be informed of the credit via an email which will notify the change in the status of the order which will change to Order in progress.

PayPal

By choosing PayPal as a payment method, the user will be safely redirected to PayPal's protected server, where they can pay with the main enabled credit cards (e.g. VISA, MASTERCARD).

* NB: By choosing this payment method, it is essential that the shipping address registered in the site account is the same as that of the PayPal account, otherwise the order will be canceled and the payment will be refused.

Scalapay

If you buy with Scalapay you receive your order immediately and pay in 3 installments. By choosing Scalapay as a payment method, the user will be safely redirected to the protected Scalapay server and acknowledges that the installments will be transferred to Incremento SPV Srl, to related parties and their assignees, and who authorizes such transfer. The maximum limit for making a purchase with Scalapay is 1500 Euros.

 

Product Information

The images and descriptions reproduce the characteristics of the items as faithfully as possible. However, the colors of the Products may differ from the actual ones due to the settings of the computer systems or devices used by users to view them. Furthermore, images of the Products may differ in size or in relation to any accessory Products. These images must therefore be understood as indicative and with the tolerances of use. For the purposes of the purchase contract, the description of the Product contained in the order form sent by the user will prevail.

 

Tax documentation

For each order placed as a "Private Customer", PSKMEGASTORE will issue an RA (Purchase Receipt) equivalent to the receipt and therefore valid as a Product Warranty.

If you wish to receive, alternatively, an invoice (for tax reasons), you must specify this by ticking the "I would like to receive an invoice" box on the "Order confirmation" page (after completing the order) and entering the tax code in the appropriate field.

For each order placed as a "Company" or "Individual company/Professional", to receive the invoice, simply fill in the appropriate fields in the registration form.

In any case, for the issuing of the tax document, the information provided by the Customer at the time of the order is valid.

Invoices will not be issued for customers who have not expressed the aforementioned request during the purchase, following the required procedures.

The tax documentation is inserted at the time of shipment inside a transparent envelope applied to the outside of the package and can also be downloaded through the "View my tax documents" section in your "Account" area.

The customer can, however, request a copy by filling out the appropriate online form at any time.

The tax documentation (purchase receipt and/or invoice) must be carefully preserved, representing the valid document for the guarantee on the Product.

 

Order Fulfillment

PSKMEGASTORE , in order to guarantee a correct service to its Customers, guarantees the receipt and acceptance of purchase orders until 12.00 from Monday to Friday; orders received after this time, as well as those received on a Saturday, Sunday or other public holiday, will be considered received on the first working day following that of the order itself. Any decreases in working hours and/or interruptions of sales services in particular periods of the year (e.g. summer months) which could lead to an extension of delivery times will be adequately highlighted at the time of the order, and will be at the discretion of the Customer proceed or not to confirm the same according to the times indicated.

Upon delivery of the goods the Customer is required to check:

that the number of packages delivered corresponds to what is indicated in the transport document

that the packaging is intact and unaltered even in the closing tapes.

In the event of tampering and/or breakages, the Customer must immediately contest the shipment and/or delivery by placing the words "RESERVE FOR DAMAGED PACKAGING" on the copy of the delivery document to be returned signed to the courier or other operator who delivered the goods. In any case, without prejudice to the application of the rules regarding the right of withdrawal and legal guarantee of conformity as better specified in the following paragraphs, the Customer must promptly communicate any tampering and/or breakage of the packaging by registered mail or by email or via the appropriate online form, below are the references:

For each delivery order the Customer is required to specify at least one telephone number to allow the express courier to contact him in case of delivery difficulties; if the delivery is not successful for reasons not attributable to PSKMEGASTORE or the express courier for more than 5 consecutive days, the order will be considered canceled and the Customer will be charged for storage costs as quantified by the express courier.

 

Legal guarantee of conformity and conventional guarantee

All Products presented on the PSKMEGASTORE Site benefit from the legal guarantee of conformity (mandatory). Only some Products benefit from a conventional guarantee, so-called. of the manufacturer (optional); the latter, once offered, becomes binding on those who propose it. The warranty itself can also be optionally extended by the Customer interested in this, according to the methods illustrated in the specific Warranty Extension page.

The consumer customer who pursuant to art. 3, I paragraph, letter. a) of the Consumer Code is the natural person who acts for purposes unrelated to any entrepreneurial, commercial, artisanal or professional activity carried out or makes the purchase without indicating a VAT number in the order form), will be able to make use of the guarantee legal compliance, in application of articles 128 -135 septies of the Consumer Code as amended by recent European provisions, whenever a lack of conformity is found.

There is a lack of conformity when the purchased good does not satisfy the subjective and/or objective conformity requirements (where relevant), and precisely:

the good does not have the characteristics referred to in the sales contract;

the good is not suitable for the particular use desired by the consumer and which was brought to the attention of the seller at the time of conclusion of the contract and which the seller accepted;

the good is without accessories, instructions, including those relating to installation and updates if provided for in the sales contract;

the good is not suitable for the use for which goods of the same type are usually used;

the good does not conform to the description made by the seller and does not possess the qualities of the good that the seller presented to the consumer as a sample or model;

the good does not have the usual qualities and performances of a good of the same type, which the consumer can reasonably expect, also taking into account the declarations made in advertising or labelling;

Any failures or malfunctions caused by accidental events or by the user's responsibility or by use of the Product that does not comply with its intended use and/or with respect to what is provided in the technical documentation attached to the product are therefore excluded from the scope of the legal guarantee. Product

The legal guarantee is reserved for consumers. It, therefore, applies only to users who fall into the category referred to in the art. 3, I paragraph, letter. a) of the Consumer Code, as defined above. For those who have purchased on the Site but who are not consumers, for any lack of conformity existing at the time of delivery of the Product, the rules relating to the guarantee referred to in the civil code with the relevant terms, forfeitures and limitations will apply.

Given these clarifications, PSKMEGASTORE is therefore responsible towards the consumer customer

for any lack of conformity existing at the time of delivery of the Product;

occurring within two years of such delivery.

Unless proven otherwise, it is presumed that defects of conformity which appear within twelve months of delivery of the Product already existed on that date, unless this hypothesis is incompatible with the nature of the Product or the nature of the lack of conformity.

Starting from the thirteenth month following delivery of the Product, it will be the consumer's burden to prove that the lack of conformity already existed at the time of delivery of the same.

In order to take advantage of the legal guarantee, the Customer must first provide proof of purchase. It is therefore advisable to keep, for the purposes of this proof, the tax documentation (Invoice or Purchase Receipt) received or any other document that can certify the date of the purchase (for example the credit card statement or the bank account statement) and open a ticket in the returns area through the "Customer Support" section or by sending an email to servizioclienti@pskmegastore.com or by sending a registered letter to the address: PSK AD NETWORK SRL, Via Napoli 157, 80013 Casalnuovo Di Napoli, Naples, Italy.

From time to time PSKMEGASTORE will give prompt feedback, will possibly proceed with the request for further and specific documentation, and will indicate to the Customer, also depending on the situation and the defect found, the procedure to follow.

In the event of a lack of conformity, the Customer has the right to have the goods restored to conformity or to receive a proportional reduction in the price or, again, to terminate the contract.

For the purposes of restoring the conformity of the goods, the consumer customer can choose between repair and replacement, as long as the chosen remedy is not impossible or, compared to the alternative remedy, does not impose disproportionate costs on PSKMEGASTORE. In such cases, or even in the event of termination of the contract, and in any case whenever the goods must be returned by the Customer, the latter must place it in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals , cables, etc.). To limit damage to the original packaging, we recommend placing it in a second box and not placing labels or adhesive tape directly on the original packaging of the Product.

The Customer will be provided with a Product Return Authorization (RMA) number which must be indicated on the outside of the packaging, following the instructions provided directly in the relevant authorization email.

 

Legal guarantee of conformity Outlet Products

For used and reconditioned Products, also in application of the provisions of the art. 133 paragraph IV of the Consumer Code, shorter terms are foreseen. PSKMEGASTORE therefore, in the presence of a lack of conformity relating to these categories of Products, will be liable towards the consumer for any lack of conformity existing at the time of delivery as long as it manifests itself within 1 year of it.

In accordance with the provisions, the consumer customer who falls into the category referred to in the art. 3, I paragraph, letter. a) of the Consumer Code, as defined above, you can make use of the legal guarantee of conformity, within 12 months from the date of delivery of the Products by opening a ticket in the returns area through the "Customer Support" section or by sending a PEC to the address passionteck@pec.it or by sending a registered letter to the address: PSK AD NETWORK SRL, Via Napoli 157, 80013 Casalnuovo Di Napoli, Naples, Italy .

After 12 months, PSKMEGASTORE will not be responsible for any lack of conformity found by the Customer.

It is specified that any defects highlighted in the description sheet of the used and/or reconditioned Product will not be covered by the legal guarantee: therefore if it has been reported that there is an aesthetic defect that does not compromise its use, the guarantee will not cover that defect specific.

Conventional guarantee

The Products sold on the Site may be covered by a conventional warranty issued by the manufacturer ('so-called conventional warranty'). As already indicated above, it binds whoever offers it, therefore the Customer can assert this guarantee only against the manufacturer himself. The duration and conditions as well as the methods of use, the types of damage/defects covered and any limitations of the conventional warranty depend on the individual manufacturer and are indicated when existing, in the so-called warranty certificate contained in the Product packaging.

The conventional guarantee is voluntary in nature. It does not replace and does not limit or exclude the legal guarantee.

 

Transport Insurance

Pursuant to art. 63 of the Consumer Code, the risk of loss and damage to the goods, for reasons not attributable to the seller, is transferred to the consumer when the latter, or a third party designated by him and other than the carrier, physically takes possession of goods.

The Customer who at the time of purchase has decided to make use of the extra insurance service for the transport of the purchased goods, in the event that he finds anomalies at the time of delivery (damaged packaging or in any case altered seals, damaged product or scratched, lack of one or more packages ordered), must accept the Product by writing on the document provided by the carrier: "ACCEPTED WITH RESERVATION" + description of the anomaly found.

In fact, to assert the insurance coverage it is not sufficient to note "IT IS ACCEPTED WITH RESERVATION" or "IT IS ACCEPTED WITH RESERVATION OF CONTROL", but rather the reason for the reservation must be explained in detail. If the package or the Product were to present visible damage, scratches or any other type of anomaly and the courier were to refuse to have a specific reserve placed, the goods must be rejected and the incident must be reported immediately (and in any case in a timely manner) to the delivery service. In any case, without prejudice to the seller's obligations in terms of legal guarantee pursuant to articles. 128 et seq. of the Consumer Code, PSKMEGASTORE will not be held responsible for any anomalies found in the state of the Product, after delivery, if the Customer, in the presence of an anomaly, has accepted the package without placing a specific reservation (in the correct manner indicated above).

Any damage or anomalies must in any case be reported to Customer Service by opening a Ticket in the "Customer Support" section. The request must be sent no later than 8 calendar days from receipt of the goods.

Any report beyond the aforementioned deadlines will not be taken into consideration.

 

Right of withdrawal

PSKMEGASTORE  recognizes the right of withdrawal as provided for by the art. 52 et seq. of the Consumer Code.

In particular, if the Customer is a consumer (who falls within the category referred to in art. 3, paragraph I, letter a) of the Consumer Code, as defined above, i.e. a natural person who purchases the goods for non-relevant purposes to their professional activity and does not make the purchase by indicating a VAT number in the order form), has the right to withdraw from the purchase contract, without the need to provide explanations and without having to incur costs other than those which will be specifically described below. indicated.

The Customer who wishes to exercise the right of withdrawal is required to notify it within 14 days starting from:

in the case of an order relating to a single Product, from the day on which the user or a third party, other than the carrier and designated by the user, acquires physical possession of the goods;

in the case of multiple goods ordered by the consumer through a single order and delivered separately, from the day on which the consumer or a third party, other than the carrier and designated by the consumer, acquires physical possession of the last good;

in the case of an order relating to the delivery of a Product consisting of multiple lots or pieces, from the day on which the user or a third party, other than the carrier and designated by the user, acquires physical possession of the last lot or piece;

For the purposes of correctly exercising the right of withdrawal, in compliance with the terms indicated above, the Customer must inform the seller of his intention to withdraw and may do so with any explicit declaration from which the intention to exercise this right can be deduced.

It will in fact be possible:

by sending an email to ufficioclienti@pskmegastore.com, as well as a registered letter with return receipt to the postal address "PSK AD NETWORK SRL" - Via Napoli 157, 80013 Casalnuovo Di Napoli, Naples, Italy.

Regardless of the manner in which this right is exercised, it is in the Customer's interest and responsibility to specify the order number and the Product for which he intends to withdraw.

PSKMEGASTORE,  depending on the manner in which the withdrawal declaration was made, will also contact them in order to indicate the exact address to which the Product will be sent.

For the correct exercise of the right of withdrawal by the Customer, we specify that:

he must return the goods, using a carrier of his own choice and at his own expense, without undue delay and, in any case, within 14 calendar days from the date on which the seller authorizes the return by specifying the address of destination of the Product to be returned. The deadline is respected if the Customer sends the goods back before the expiry of the fourteen day period. The direct costs of returning the Products are, therefore, always borne by the user;

The Product must be returned in compliance with resale (intact and complete with the original packaging);

you are solely responsible for any decrease in the value of the goods resulting from handling the Product other than that necessary to establish the nature, characteristics and functioning of the Product. The Product must in any case be kept, handled and inspected with normal diligence and returned intact, complete in all its parts, in perfect working order, accompanied by all accessories and information sheets, with identification tags, labels and disposable seals - where present - still attached to the Product and intact, not tampered with, as well as perfectly suitable for its intended use and free of signs of wear or dirt. You can exercise the right of withdrawal in relation to the Product in its entirety and not for parts and/or accessories of it. In the event that the serial code of the same is inserted on the packaging of the Product, as for example, for electronic Products, it constitutes part of the Product and, consequently, the Product must be returned in the original packaging, which in turn must be placed in additional packaging, as no other label or tape can be affixed to the original packaging;

It is further specified that:

the seller will retain the delivery costs paid by the Customer at the time of purchasing the Product.

It therefore follows that, given the right of withdrawal correctly exercised by the Customer, the refund will only concern the sums paid for the price of the Product;

the seller is not required to reimburse the Customer for additional costs if the consumer has expressly chosen a type of delivery other than the cheapest one provided by the Site;

the seller will withhold the refund until it has received the goods;

 

Refunds

As already mentioned above, the refund will only concern the sums paid for the price of the Product, and will be made no later than 14 days from the communication by the Customer to exercise the right of withdrawal (provided that the Product has been delivered to the seller ).

In the event that the Product for which the withdrawal was exercised has suffered a decrease in value resulting from handling of the goods other than that necessary to establish the nature, characteristics and functioning of the Product, the refund amount will be reduced in the opinion of the seller, for an amount equal to this decrease in value. PSKMEGASTORE will notify the user of the circumstance and the consequent decreased refund amount, by e-mail, or via ticket within 7 working days of receipt of the Product. It is understood that in the event of a partial refund, the Customer may also decide to refuse this option and take the product back, again at his own expense.

The refund amount will be communicated to the user via e-mail or via ticket and, in any case, refunds will be made by PSKMEGASTORE in one of the following ways:

Bank transfer if the Customer paid by bank transfer and/or cash on delivery;

Credit card if the Customer paid by credit card;

Paypal if the Customer paid with Paypal.

Credit card or account associated with the service if the Customer paid with Scalapay.

In the event that goods already paid for are refused delivery, the refusal will be considered as a request for withdrawal, therefore upon return of the Product the outward and return costs of the goods will be deducted.

The art. 59 of the Consumer Code provides exceptions to the right of withdrawal. Among these exceptions, those connected and referable to the sale of goods referred to on the Site can be summarized as follows:

supply of sealed goods which are not suitable for return for hygienic or health protection reasons and which have been opened after delivery or in the case of supply of Products which are, after delivery, inseparably mixed with other goods;

supply of sealed audio or video recordings or sealed computer software that has been opened after delivery;

supply of tailor-made or clearly personalized goods;

supply of goods which are likely to deteriorate or expire rapidly;

service contracts after the complete provision of the service, if you have expressly consented to the execution of the service by us accepting the loss of the right of withdrawal following the full execution of the contract;

 

Sales Contract and information aimed at its conclusion

In compliance with the provisions of the Consumer Code as well as those referred to in Legislative Decree no. 70/2003 and subsequent amendments, PSKMEGASTORE wishes to inform the Customer that:

to conclude the purchase contract for one or more Products on the Site, the user must fill in all the mandatory fields required in the cart, relating to contact details and must also choose a payment method and a shipping method;

before concluding the purchase contract, the user will be able to identify and correct any data entry errors by following the instructions on the Site itself, in the various stages of the purchase;

the data transmitted to PSKMEGASTORE will be processed by it in accordance with current legislation on data protection including, by way of example, Regulation (EU) 2016/679 (GDPR) and Legislative Decree. 196/2003 and subsequent amendments. (Privacy Code) and will be kept only for the time necessary for the execution of the contract, and in any case for specific purposes;

the user will be able to access the order form and the data relating to it through the Account section which can be accessed after registering on the Site;

the contract is concluded when the order confirmation arrives in the  PSKMEGASTORE system

The Customer can only purchase the Products, as per the electronic catalog on the Site, existing at the time of placing the order.

It could happen, and only in conjunction with multiple purchases on the site by multiple users, that a Product marked "available" is in fact no longer available. Therefore, and only in such cases of multiple purchases, PSKMEGASTORE will promptly communicate to the Customer the non-acceptance of the order sent for the aforementioned reasons.

PSKMEGASTORE  confirms the correct receipt of the order by sending an e-mail to the e-mail address communicated by the Customer, which will indicate all the data relating to the order placed. The Customer, even at this stage, undertakes to verify its correctness and to promptly communicate any possible corrections. Having verified the actual availability of the goods as well as the accuracy of the Customer data, PSKMEGASTORE will send the definitive acceptance of the contract via e-mail, which only from this moment must be considered concluded and stipulated between the parties for all legal purposes.

The Customer may request from   PSKMEGASTORE , by certified e-mail to the address: passionteck@pec.it a copy of the contract concluded on paper, indicating exactly the address to which this consignment must be forwarded.

By placing the order on the Site, the Customer declares to have read the conditions of sale and the proposed payment methods, as well as the entire purchase procedure and also declares to accept them. Please note that the conditions of sale are also sent in PDF format attached to the order confirmation.

Following the conclusion of the purchase procedure, together with the shipment of the goods, PSKMEGASTORE will issue tax documentation, which will be attached to the Product and can also be downloaded from the "Account" section.

Upon request (through the contact area https://pskmegastore.com/it/module/wkrma/rmarequests) it can also be sent by e-mail to the order holder as required by former Art. 14 Presidential Decree 445/ 00 and DL 52/2004 and any other relevant regulation.

PSKMEGASTORE includes in the tax documentation only the data provided by the Customer at the time of the order, specifying that no changes will be permitted after the order has been issued.

The sales contract between the Customer and PSKMEGASTORE is intended to be concluded in Italy and regulated by Italian law.

For disputes relating to problems connected to the purchase of a Product, or relating to the validity, effectiveness, interpretation or execution of the contract as well as, in general, relating to navigation on the Site by the Consumer Customer or to the use of any functionality made available its provision on the Site, the latter is required to forward a complaint directly to the seller in order to expose the problem and explore possible solutions.

However, if following it it was not possible to resolve the dispute, PSKMEGASTORE informs the consumer customer that a European platform for the online resolution of consumer disputes (so-called ODR platform) has been established. It can be consulted at the following address http://ec.europa.eu/consumers/odr/ .

Through the ODR platform the Customer can send a complaint relating to the contract concluded online with PSKMEGASTORE by activating the online dispute resolution procedure. The email address of the professional seller to include in the complaint is reclami@pskmegastore.com.

The use of an out-of-court settlement procedure for the dispute does not prejudice the possibility for the consumer customer to appeal to the judicial authorities (art. 141, paragraph X of the Consumer Code). In fact, regardless of the outcome of the out-of-court settlement procedure, the consumer retains the fundamental right to appeal to the competent judicial authority. In this regard, if the Customer is a consumer pursuant to the Consumer Code, the territorial jurisdiction is that of the Court in which he resides or has elected domicile; in all other cases, the territorial jurisdiction is exclusively that of the Court of Naples.
